Child Support
In light of the changes to the Child Support arrangements after 1 July
2008 which would have meant a reduction in the child support payable to
our client, we negotiated a child support agreement for our client so
that her husband (who earns about $350,000 a year) pays child support
which is commensurate with his earning capacity. He now pays
$2000 per week plus all school fees and expenses, extra curricular
activities, private health cover and gap medical and dental
costs. Our client is able to continue her role as the children’s
primary carer which both parents agree is in the best interests of
their children rather than needing to return to work to meet their
everyday expenses.
Our client signed a child support agreement when he left his wife
several years ago. When he came to see us, he had lost his job
and had a new family. He couldn’t afford to keep paying child
support at the rate he had agreed to under the agreement. His
ex-wife wouldn’t agree to set aside the agreement. After a long
Court battle, the judge discharged the child support agreement and
ordered that child support should be paid in accordance with the
administrative assessment made by the Child Support Agency. Now
that our client is working again, he is able to meet his child support
commitments to his children from his first marriage and support his new
family.
