Children’s Court matters
This is a particularly specialised area of family law and generally involves Children being removed from their parents due to neglect or abuse, usually as a consequence of drug use, mental health issues or domestic violence. We recently acted for some grandparents who had had the care of their two young grandchildren for several years after their daughter was no longer able to care for them. For financial reasons the grandparents had moved interstate and the father of one of the Children was attempting to get orders from the Children’s Court for both children to spend time with him in Sydney notwithstanding a long history of family violence against the Children’s mother. Although the father made no financial contribution to the Children’s care, he was also seeking orders that the grandparents pay for the Children’s travel between the two states. We acted for a father of two young children, who had a major breakdown at the time of his separation. He had a history of mental health issues and was using alcohol as a crutch to help him through. The mother, who was from overseas decided she wanted to move back to her birthplace. On his first day before the Court (before he had representation) our client agreed to supervised time with his children without any understanding of how long that arrangement would remain in place. After he came to see us, we helped him secure appropriate supports to get his life back on track and we defended the mother’s relocation application on his behalf. The matter finally settled with the Mother agreeing not to move back to her birthplace and the Children now spend five nights a fortnight and half of all school holidays with our client.
