Our client, wanted to stay in her home with the teenaged
Children. We negotiated an agreement with our client’s ex husband
for her to make payments in instalments to him over the next 2 years so
she could afford to keep the house.
Our client and her husband couldn’t agree on the percentage split after
their property was sold. The husband had owned the former
matrimonial home prior to the parties’ 35 year marriage. He
believed because he owned the house that he should be entitled to more
than 50% of the asset pool. At the time of separation, the
parties had one 15 year old child who was spending equal time with each
of his parents. After a contested hearing, our client was
successful in achieving an equal split of all the property including
the husband’s superannuation which had accrued during the
marriage. She was able to use the equity in the former
matrimonial home (which was sold) to rehouse on the Northern Beaches
and still has some superannuation which she can rely on in retirement.
