If a couple decides to purchase a property together, it is sensible to have a financial agreement in place that maps out how the property will be dealt with if separation occurs. However, in the case where there is no agreement and there is to be an adjustment of your respective property interests, we can provide advice and representation to guide you through the legislative pathway. When matrimonial or relationship property is divided, the law sets out a 5-step process:

Looking at the relationship as a whole, is it just and equitable to make an adjustment of your property interests?

If the answer to 1. is yes, then next steps are to:

• Identify the net asset pool for distribution, including superannuation and liabilities.
• Determine individual contributions to the acquisition and maintenance of the asset pool. Contributions may be financial, non-financial and homemaker.
• If needed, adjust the contributions based percentage entitlement, considering the potential financial needs of each party.
• Ensure that any division is done in a fair and just manner.

We often hear questions such as “Can I relocate interstate or overseas with my kids after my separation”?
